These Terms of Service ("Terms") govern your use of Varða, a compliance-assessment tool operated by [Business Name] ("we," "us," "our"). By accessing or using Varða, you agree to these Terms.

1. What Varða is, and isn't

Varða uses AI (Anthropic's Claude models) to analyse policy documents and evidence against compliance frameworks such as ISO 27001, CPS 234, CPS 230, NIST CSF, Essential 8, and SMB1001, helping you prepare for a real audit by surfacing likely findings and evidence gaps ahead of time: producing gap assessments, evidence request lists, and control effectiveness testing output you can act on before an auditor asks for it.

Varða is an audit-readiness and preparation tool, not the audit itself, and not a substitute for professional audit, legal, or regulatory advice. AI-generated ratings, narratives, and gap assessments are intended to help you identify and close gaps ahead of a real audit; they are not a certification of compliance, and no output from Varða should be relied upon as a final compliance determination without review and sign-off by a suitably qualified professional.

2. Your responsibilities

You're responsible for the accuracy of anything you upload or type into Varða, and for keeping the access password confidential if one has been shared with you.
You're responsible for reviewing, editing, and approving every AI-generated output before relying on it: Varða is built around the principle that a human reviewer always has final say, and every AI-generated field can be overridden.
You won't use Varða to upload or process content you don't have the right to share, or in any way that violates applicable law.

3. Your data, your ownership

You retain ownership of everything you upload or type into Varða: your policy documents, your evidence, your assessment results. We don't claim any ownership over your content. See our Privacy Policy for how that data is handled, stored, and shared with the infrastructure providers (Anthropic, Microsoft Azure) needed to run the service.

4. Availability

Varða is an early-stage product. We don't currently guarantee any specific uptime, and the service may be unavailable during updates or maintenance. We'll aim to keep disruption minimal, but you should not treat Varða as your sole system of record for compliance evidence.

5. Limitation of liability

To the maximum extent permitted by law, Varða and its operator are not liable for any indirect, incidental, or consequential loss arising from your use of the service, including any regulatory, financial, or reputational consequence of relying on an AI-generated assessment without independent professional review. Varða is provided "as is," without warranties of any kind, express or implied.

6. Intellectual property

The Varða name, branding, and underlying software are owned by [Business Name]. Nothing in these Terms grants you rights to our software, trademarks, or branding beyond what's needed to use the service as intended.

7. Termination

We may suspend or revoke access to Varða at any time, particularly for misuse or a breach of these Terms. You may stop using Varða at any time.
